The eligibility of former President Donald Trump for the 2024 presidential ballot is at the center of a legal debate that could significantly impact the upcoming election.

The controversy revolves around the interpretation of Section 3 of the 14th Amendment of the U.S. Constitution, particularly whether a U.S. president is classified as an “officer of the United States.”

In recent developments, both Colorado and Maine have ruled against Trump’s eligibility. The Colorado Supreme Court and Maine’s Secretary of State Shenna Bellows have cited the 14th Amendment in their decisions, a measure originally enacted to prevent Confederate leaders from holding federal office after the American Civil War.

Legal experts are divided on the issue. Harvard University professor Laurence Tribe supports the view that the president is indeed an officer under the amendment. Contrarily, Richard Epstein of New York University and former First Assistant U.S. Attorney Andy McCarthy argue that the Constitution’s appointments clause suggests otherwise.

Jeremy Rabkin from the Antonin Scalia Law School expresses doubts about the amendment’s applicability to the president and questions whether Trump’s actions meet the definition of “insurrection” as stated in the amendment.

The U.S. Supreme Court is scheduled to hear oral arguments in the case, Trump v. Anderson, on February 8. This case is pivotal, as it will address Trump’s eligibility and could set a precedent affecting his presence on ballots across various states.

Additionally, a lawsuit in Illinois is also leveraging the 14th Amendment to challenge Trump’s candidacy, indicating the widespread legal challenges he faces nationwide.
